Plaintiffs' (Wylie's) Response to the Texas 12th Circuit Court

Wylie v HAWL/Church Cause 08-2127-B

 

FROM THE COURT RECORD:

 

“It is documented that Plaintiffs (Wylie) did not want to sue the Church. Plaintiffs initially sued HAWL and its board members, leaving the Church out. This was purposeful, as the Plaintiffs did not want the people of the Church to be put through what they perceived as a Hide-A-Way Lake Club, Inc., problem. Ultimately, it is HAWL's responsibility not to wrongfully lease property to nonmembers, and to ensure its deed restrictions and other governing documents are abided by. Were that happening, there would not be an issue. Only when HAWL sought dismissal alleging that the Church was an indispensable party did the Plaintiffs seek leave to sue the Church, as their case would otherwise have been dismissed.”
