Every two years the Texas
legislature meets to pass some watered-down protection for
Texas Homeowners
Associations.
There is NEVER a compliance requirement in these laws,
never.
A Texas HOA Board of Directors can choose to obey or not obey Deed
Restrictions, Rules and/or
Regulations of the
corporation.
A legal burden is placed on each Homeowner to enforce State Law!
(The Homeowner must
file a lawsuit to enforce
his/her rights.)
I propose
a:
“Texas Homeowners Board for The Protection
of Homeowner’s Rights.”
Any Homeowners
Association, in Texas, that has a legal right of foreclosure, for any reason,
would submit to this new State
Regulatory Board under the supervision of the Texas Attorney
General.
COMPLY WITH STATE LAW OR LOOSE YOUR CORPORATE CHARTER
You, as a member of a
Homeowners Association, are better protected from getting a bad haircut than
having your homestead sold, fines levied, and dues increased. (Barbers are
state regulated.)
As an
example, you are protected by the State of Texas from errant behavior of the
following, just to name a few.

Trainer
Boxing
Promoter
Insurance
Adjuster
Insurance
Agent
Interior
Designer
